TERMS AND CONDITIONS

of Footballerista Marketing(Suisse) AG

1. SERVICES

1.1 Madridista(hereinafter referred to as 'subscription') is the official membership service for the Spanish based Real Madrid CF football club with benefits, sports and entertainment content sold by Footballerista, the exclusive distribution partner for the Indian market in accordance with these terms and conditions and provided by Real Madrid CF as the rights holder and content provider. The customer must take out a subscription in order to use the Madridista service. Monthly and annual subscriptions are available for Madridista. If third-party subscriptions are offered (e.g. TATA Play or FairPlay Mobile), their commercial offers (monthly or annual subscription with or without a contract) shall apply, along with their general terms and conditions and fees. The customer orders a subscription with Madridista. Each service can be offered to the customer with individual package offers at different subscription prices.

1.2 The services are available on supported, internet-enabled end devices. These are typically PCs, laptops, tablet PCs or smartphones.

1.3 Footballerista is not liable for editorial content from third-party providers offered as part of the service, nor for partner content from third-party providers. The content of the service and the sports channels and packages may vary depending on the season or the availability of the respective programmes, for which Footballerista assumes no responsibility.

2. TERMS OF USE

2.1 Internet connection

The customer requires a stable internet connection to use the service. It is the customer's responsibility to ensure sufficient and stable data transfer. Fees for internet connection and access are to be borne by the customer.

2.2 Registration and minimum age

Only persons of legal age and residing in India are entitled to subscribe to the service. A customer number or email address and a password created by the customer during registration must be entered before each use. For security and data protection reasons, the customer is advised to change his password regularly on the www.youlovesport.in website. Customers must never disclose their password to third parties.

3. DUTIES OF THE CUSTOMER

3.1 The customers may only use the service in accordance with these conditions. The service contents are protected by law, in particular by copyright and related rights.

3.2 Footballerista reserves the right to take legal action against customers who violate these conditions. In the event that the customer passes on login data to third parties, Footballerista is entitled to impose a contractual penalty on the customer. This shall be double the annual subscription fee.

3.3 Protection of minors

The customer is obliged to take appropriate measures to ensure that minors are not given access. In particular, he must protect his login data accordingly.

3.4 Personal data

The customer must notify customer services immediately of any changes to personal data (e.g. method of payment, payment details, address, email address and/or telephone number) in relation to the service. If you want to delete your personal data you must notify customer service and in addition Madridista.com.

4. PAYMENT TERMS

4.1 The fee for the one-time subscription is due upon conclusion of the contract and is payable immediately. The one-time subscription ends at the time the selected event ends and is not automatically renewed.

4.2 The fees for the monthly subscription are initially due on the day of the conclusion of the contract, which is also the start date for the subscription. The subscription fees will be invoiced on the specified payment date, which can be viewed on the 'My Account' subscription renewal information page. The subscription will automatically renew and the subscription fees will automatically be charged for the subsequent month.

4.3 The fees for the annual subscription are due on the day the contract is concluded, which is also the start date for the subscription. The annual subscription will automatically renew at the end of the year and the subscription fee will automatically be charged in advance for the following year.

4.4 The customer shall pay for each subscription using the payment method selected by him and it is the customer's sole responsibility to keep his payment information up to date. In the event of a failed payment transaction due to invalid payment data, the subscription in question will be immediately suspended and the customer will be deprived of the right to view content until he provides valid payment data. The customer is liable for any unpaid amounts.

4.5 For paid Madridista memberships, the fees for access to content are due in advance, i.e. before the customer is granted access to content.

4.6 Footballerista offers the customer various payment options, in particular payment by credit card or via UPI. Footballerista is free to add new payment methods.

4.7 The currency of the subscription is applied in Indian Rupees (symbol: ₹; code: INR), European Euros (symbol: €; code: EUR) or US American dollars (symbol: $; code: USD).

4.8 Footballerista may outsource payment processes to third parties and hereby authorises customers to carry out credit checks and collect payment information.

5. DATA PROTECTION

5.1 All information on data protection can be viewed on the www.youlovesport.in website.

6. CONTRACT DURATION / CANCELLATION

6.1 The subscription begins on the day the contract is concluded. Both Footballerista and the customer are entitled to terminate the 'annual subscription' and 'monthly subscription' with effect from the last day of the current monthly or annual subscription (as applicable). Customers may only cancel subscriptions on the www.youlovesport.in website in the 'My Account' area. If neither party cancels the contract, it will be automatically renewed.

6.2 Footballerista is not responsible for disruptions or interruptions to the services provided due to force majeure, i.e. for circumstances beyond the control of Footballerista (e.g. fires, earthquakes, pandemics, telecommunications service failures and other natural disasters that could damage the installations).

7. TRANSFER OF RIGHTS AND OBLIGATIONS

7.1 The customer may not transfer his rights or obligations under the subscription contract to third parties without the permission of Footballerista. Footballerista is entitled to transfer the payment claims against the customer and all rights and obligations under the subscription contract to third parties without the consent of the customer. In the event of the transfer of all rights and obligations, Footballerista will inform the customer four weeks in advance. The customer is entitled to terminate the subscription contract at the time the transfer comes into effect.

8. PRICE ADJUSTMENT

8.1 Footballerista may increase subscription fees ('price increase'). Footballerista will inform the customer of a price increase at least two weeks before it comes into effect.

8.2 If a price increase amounts to more than fifteen percent of the subscription fees applicable at the time of the increase, the customer is entitled to terminate the subscription contract immediately on the www.youlovesport.in website ('My Account').

8.3 Price increases of partner offers with a commitment period require a written cancellation, which is to be sent at any time after receiving notification of the increase. The cancellation will take effect at the time the price increase comes into force.

8.4 The right of cancellation applies exclusively to the product affected by the price increase. If the product affected by the price increase is a requirement for another product, the cancellation shall also apply to that product. If the customer does not cancel the subscription by the deadline, the subscription shall be continued with the new subscription fees.

8.5 The provisions of 8.2 and 8.3 shall not apply if Footballerista adjusts subscription fees accordingly due to an increase or decrease in statutory VAT.

9. CHANGES TO THESE TERMS AND CONDITIONS

Footballerista may amend these Terms within two weeks if the amendment is reasonable for the customer, taking into account the interests of Footballerista. The power to amend shall not apply to material provisions of the contractual relationship, in particular to the type and scope of the agreed mutual services and the term. If the customer does not object to the amendment within the time limit set by Footballerista, the amendment shall be deemed approved.

10. MISCELLANEOUS

These terms and conditions are subject to Swiss law and any customer rights prescribed by Swiss law remain unaffected. The exclusive place of jurisdiction for disputes in connection with these terms and conditions is Zurich. Should individual provisions prove to be invalid, unlawful or unenforceable, the validity of the remaining provisions shall remain unaffected.
